Background
This agreement applies as between you, the User of this Web Site and Legal Avinu, the owner(s) of this Web Site. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Web Site. If you do not agree to be bound by these terms and conditions, you should stop using the Web Site immediately.

Definitions and Interpretation
In this Agreement the following terms shall have the following meanings:
“Content” means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site:

“Legal Avinu”
“Legal Avinu” means the trading name of Avinu Marketing, a company registered in the United Kingdom with company number 12268292, and having its registered office at 201 Chudleigh Road, Brockley, London SE4 1EG.

“Service”
means collectively any online facilities, tools, services, or information that Legal Avinu makes available through the Web Site either now or in the future.

“System”
means any online communications infrastructure that Legal Avinu makes available through the Web Site either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links.

“User”
means any third party that accesses the Web Site and is not employed by Legal Avinu and acting in the course of their employment; and We do not give legal advice; Our service is limited to the process and administration of providing your contact details to a panel of law firms that can advise you accordingly.

You do not need to use a case management company to make a claim. You have the right to use any of the appropriate regulatory bodies for free in relation to your claim, including:

How we will assist you
Legal Avinu provides this site, as part of an introductory service that aims to put you in touch with a specialist law firm without delay. We will not charge you anything for doing this. Further details about our arrangement with our panel of firms are available on request. Legal Avinu are not qualified lawyers and do not provide legal advice. If we feel we cannot help you, we will let you know.

Any resulting contract that you enter for legal services will be with one of our panel of solicitor firms, not Legal Avinu. Legal Avinu therefore, do not accept any responsibility or related liability for any advice given to you or other work conducted on your behalf, by our panel of law firms, or any solicitor that you chose to appoint. You are under no obligation to instruct one or any of our panel law firms. Solicitor firms pay for marketing, call handling and other services. This does not affect the value of your claim in any way. If you are close to the time limit for making a claim, do not wait, contact the solicitor firm immediately.

Contacting Us
When telephoning us we inform you that calls may be recorded and used for internal training and regulatory compliance purposes only.

Our policy against abusive calls
We operate a zero-tolerance policy towards the abuse of our employees who have a right to conduct their work without fear of being abused. Malicious or abusive calls are a criminal offence under Section 43 of the Telecommunications Act 1984, and Legal Avinu will not hesitate to report such acts to the police.

Where access to restricted parts of this site is subject to specific terms, those terms apply to
the extent that they differ from these Terms and Conditions. Copying from websites of third parties is subject to any requirements applicable to those sites.

Governing Law and Jurisdiction
These conditions are governed by the laws of England and Wales.

Limitation of Liability
Your use of this site is at your own risk. Save for liability which we cannot by law restrict or exclude, we shall have no liability to you or any third party for any direct, special, indirect, consequential or incidental damages, exemplary or lost profits, or any other damages of any kind whether based on warranty, contract, tort (including negligence) or otherwise, even where we have been advised of the possibility of the same. Applicable law may not allow the limitation or exclusion of liability for certain damages, so this limitation or exclusion may not apply to you in its entirety.

Law and Jurisdiction
These terms and conditions and the relationship between you and Legal Avinu shall be governed by and construed in accordance with the Law of England and Wales and Legal Avinu and you agree to submit to the exclusive authority of the Courts of England and Wales Notices All notices/communications shall be given to us either by post to our Premises (see address above) or by email to info@legalavinu.com.

Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.

No Waiver
If any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

Previous Terms and Conditions
In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

Availability of the Web Site
The Service is provided “as is” and on an “as available” basis. We give no warranty that the Service will be free of defects and / or faults. To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.

Legal Avinu accepts no liability for any disruption or non-availability of the Web Site resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship Links to Other Web Sites This Web Site may contain links to other sites. Unless expressly stated, these sites are not under the control of Legal Avinu or that of our affiliates.

We assume no responsibility for the content of such web sites and deny liability for all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this Web Site does not imply any endorsement of the sites themselves or of those in control of them.

Legal Avinu do not give legal advice. You can also seek legal services elsewhere. Your fee arrangement is dealt with between you and the law firm that is dealing with your matter. We are paid a referral fee by our panel members for a successful introduction. Legal Avinu will not charge you for our service. The No Win No Fee Success Fee is based on which expert panel member we refer you to and is payable to them. Our panel currently consists of a number of law firms. The No Win, No Fee varies, but is between 25%-50%.
